1. About these terms

These terms govern your use of the MK Group Agency website (mkgroup.co.tz) and set out the general basis on which MK Group Agency (“MK Group”, “we”, “us”) provides services. MK Group is a corporate brand and communications consultancy based in Dar es Salaam, Tanzania.

By using this website you accept these terms. Specific client engagements are governed by a written proposal, statement of work or contract signed by both parties; where that document conflicts with these terms, the signed document prevails.

2. Use of this website

The content of this website is provided for general information about our services. You may view and share it for legitimate business purposes. You must not misuse the site, attempt to disrupt or gain unauthorised access to it, or use its content in a way that misrepresents MK Group or our clients.

Portfolio and case-study material is shown with client permission. Client names, marks and work remain the property of the respective clients.

3. Enquiries and proposals

Submitting an enquiry through this website does not create a client relationship. Proposals, scopes of work and quotations we issue are valid for 30 days unless stated otherwise and become binding only when accepted in writing by both parties.

4. Services and deliverables

We deliver the services described in each agreed scope with reasonable skill and care, in line with professional standards for brand, marketing and digital consultancy. Timelines depend on both parties meeting their obligations; client delays in providing content, approvals or feedback extend delivery dates accordingly.

Unless a scope states otherwise, quoted fees exclude third-party costs such as media spend, printing, stock licensing, fonts, hosting and domain registration. Such costs are passed through with prior approval.

5. Intellectual property

On full payment, the final approved deliverables created specifically for a client transfer to that client, together with the rights needed to use them for their intended purpose.

We retain ownership of our pre-existing tools, methods, templates and know-how, and of concepts and drafts not selected by the client. We may display completed work in our portfolio and marketing materials unless the client requests otherwise in writing.

All content on this website — including text, design and the MK Group identity — is the property of MK Group Agency and may not be reproduced without written permission.

6. Confidentiality

Each party keeps the other's confidential information secure and uses it only for the purpose of the engagement. This obligation survives the end of the engagement. Confidential information does not include information that is public, already known, or required to be disclosed by law.

7. Liability

This website is provided “as is”. While we take care to keep information accurate and current, we do not warrant that the site will be uninterrupted or error-free.

For client work, our aggregate liability arising from an engagement is limited to the fees paid for that engagement. We are not liable for indirect or consequential loss, loss of profit, or loss arising from client-supplied materials, instructions or approvals. Nothing in these terms excludes liability that cannot be excluded under Tanzanian law.

8. Payment

Payment terms are set out in each proposal or contract. Unless agreed otherwise, engagements are invoiced with an initial payment before work begins and the balance on delivery or at agreed milestones. Overdue invoices may attract interest and we may pause work while an account is in arrears.

9. Governing law

These terms and any engagement with MK Group are governed by the laws of the United Republic of Tanzania. Disputes will be resolved through good-faith negotiation in the first instance, and failing that before the courts of Tanzania.

10. Changes to these terms

We may revise these terms from time to time. The current version is always published on this page. Revisions do not affect engagements already under a signed contract.
